What is the Typical Punishment for Sexual Assault in the Military?


Because of the absence of mandatory minimums in the military’s system for punishing sexual assault and rape do not exist, you can see a very vast and a very different level of punishment from one offender to the next.

Each panel and each military judge will listen to the facts and circumstances of that particular case and can bear out anything from zero punishment all the way up to the maximum punishment within the context of the new mandatory minimum Punitive Discharge. However, most typically you will see some amount of confinement, all the way up to (and including) life without parole.
